Summary
The parents of the children wanted justice to come to the school. The 8th amendment was being violated because the punishment for walking too slow when being told to speed up should not be being paddled over 20 times but something less severe. Thus this was cruel and unusual punishment to be delivered on children. Analysis I understand that parents don't want their children to be subject of such harsh punishment. The parents however should realize that once their child is out of their hands and into those of the school, they won't always knows what happened. This has been going on for so long in the school. Why did they have to wait so long to speak up? |
Summary
The principal of the school said that the 8th amendment did not apply because they were not criminals. They were his students. As acting parents to the student in a school they are allowed to hand out punishments as they see fit. Analysis As acting parents, the staff of the school has the ability to had out punishments as they see fit. Though there should be limitations and in the 1970's there weren't many to speak of. The students were, at most times, too ashamed to speak up about their injuring to their parents which encourages the staff to continue. When the student did speak up to the staff however, the punishments were more severe. Which could explain the silence of the students. |
